When do I need to file for Guardianship?
We find it is customary to file for a Guardianship when the biological parents of a child are unable to care for their children. This can be because of any of the following reasons:
- They have been found legally unfit to be raise their children because of criminal activity, child neglect and abuse, or drug abuse.
- The parents are in jail for long a long period of time.
- The parents have deceased.
The most common cases for guardianship cases involve parents who have fallen into drug use or criminal activity and are no longer fit parents.
Once a family member has guardianship of a child and gains child custody, he or she can adopt the child after going through a Termination of Parental Rights proceeding.
